Copyright complaints (DMCA)

If you believe something on morsalin.online, or a file shared through its client portal, infringes your copyright, tell me and I’ll look at it quickly. This follows the notice-and-takedown process of the US Digital Millennium Copyright Act (DMCA), and I apply it to complaints from anywhere.

What this covers

This site publishes my own content. Clients can upload files to the private portal, which only they and I can see. I’m not a US company and haven’t designated a DMCA agent with the US Copyright Office; this is a voluntary process that also covers equivalent rights under other laws.

Sending a notice

Email [email protected] with the subject “Copyright notice”, including:

  1. The copyrighted work you believe is infringed, or a representative list if there are several.
  2. The material you believe infringes it, with its exact web address or enough detail to find it.
  3. Your name, address, phone number and email.
  4. A statement that you believe in good faith that the use isn’t authorized by the copyright owner, its agent or the law.
  5. A statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act for them.
  6. Your physical or electronic signature (typing your full name is enough).

What happens next

I acknowledge a complete notice within 3 US business days. If it’s valid, I remove or disable the material promptly, and tell the person who provided it, if that wasn’t me, with a copy of the notice (your contact details may be included). Knowingly false claims can make the sender liable for damages (17 U.S.C. § 512(f)).

Counter-notices

If material you provided was removed and you believe that was a mistake or misidentification, you can send a counter-notice to the same address. It needs to include:

  • what was removed and where it was;
  • a statement, under penalty of perjury, that you believe in good faith it was removed by mistake or misidentification;
  • your name, address and phone number;
  • your consent to the jurisdiction of a court where you live (or, outside the US, any court where the complainant may sue) and to accept service from the complainant;
  • your signature.

I forward it to the complainant. Unless they tell me within 10 US business days that they’ve started court action, I may restore the material.

Repeat infringement

Client portal accounts that repeatedly upload infringing material may be closed.
